Patricia Hamill, chair of the firm’s Title IX, Due Process & Campus Discipline practice group and leading national Title IX attorney, was featured on The World and Everything In It’s daily podcast. Patricia was interviewed for the podcast’s “Legal Docket” segment and spoke with host, Mary Reichard, about accusations of sexual assault within the university campus system and what happens when a student gets caught up in accusations on campus. Patricia spoke about how a university disciplinary process typically unfolds and when and on what basis litigation against the school is instituted, and how she is involved at both stages of the process. She also discussed the emotional and practice repercussions to the students who are unjustly accused of assault yet still disciplined, and how she handles that for her clients.
Since the U.S. Department of Education required universities that receive federal funds, in effect, to lower due-process protections for students accused of sexual assault, there has been a rush to judgment when a student has been accused of sexual assault within the university campus system. Patricia defends students when a college student has been accused of misconduct and is facing a university’s disciplinary process.
