Court Dismisses "Pig Farm" Nuisance Case Against Conrad O'Brien Client, Country View Family Farms, LLC

Conrad O’Brien obtained summary judgment in the Luzerne County Court of Common Pleas in two related lawsuits filed against our client, Country View Family Farms, LLC. The suits were brought on behalf of a group of 100+ plaintiffs who sought substantial money damages resulting from allegedly noxious odors produced by operations at a Salem Township “Concentrated Animal Feeding Operation” (CAFO) where pigs owned by Country View are raised. Robert Feltoon and Andrew Garden, on behalf of Country View, argued that the cases were barred by Pennsylvania’s Right to Farm Act, which requires that all nuisance suits against agricultural operations be brought within one year of commencement of the operations.
